1. Introduction and Acceptance

These Terms and Conditions (“Terms,” “Agreement”) constitute a legally binding agreement between you (“Customer,” “you,” “your”) and Bizmorph (“Company,” “we,” “us,” “our”), governing your access to and use of our website at bizmorph.in (the “Website”) and the purchase and fulfillment of any travel, tourism, tour management, or real estate-related services we offer (collectively, the “Services”). By accessing the Website or booking any Service, you acknowledge that you have read, understood, and agree to be bound by all the terms of this Agreement. If you do not agree, you must not use our Website or Services.

2. Eligibility and Account Responsibilities
By using our Services, you represent and warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement. If you are booking on behalf of a group or another individual, you warrant that you have obtained all necessary consents and authority to bind all such individuals to these Terms. You are responsible for maintaining the confidentiality of any account information and for all activities that occur under your account.

3. Information Accuracy and Customer Obligations
3.1. You agree to provide accurate, current, and complete information required for booking Services, including full legal names as they appear on passports, contact details, and any special requirements.
3.2. You are solely responsible for ensuring that you and all members of your party possess valid passports (with at least six months’ validity beyond the travel period), visas, permits, health certificates, and travel insurance required for your chosen destinations. Bizmorph is not liable for any denial of entry, deportation, or other consequences arising from failure to meet these requirements.
3.3. You agree to comply with all laws, customs, and foreign exchange regulations of the destinations you visit and acknowledge that your conduct is your sole responsibility.

4. Booking, Pricing, and Payment
4.1. Booking Confirmation: A booking is considered a binding offer by you to purchase Services. A contract between you and Bizmorph is formed only when we send you a written confirmation of your booking via email. We reserve the right to decline any booking at our sole discretion.
4.2. Pricing: All prices displayed on our Website or quoted are in Indian Rupees (INR) unless otherwise stated. Prices are subject to change until a booking is confirmed. While we strive for accuracy, errors may occur. If we discover an error in the price of Services you have booked, we will inform you and give you the option to reconfirm at the correct price or cancel your booking with a full refund.
4.3. Payment Terms: A non-refundable deposit, as specified at the time of booking, is required to secure your reservation. Full payment is due by the balance due date stated in your booking confirmation (typically 30-45 days prior to departure). 5.2. Cancellation fees are based on the time of cancellation and the non-recoverable costs incurred by Bizmorph from our suppliers. The following general cancellation charges apply per person for standard tour packages, unless a more specific schedule is provided in your booking confirmation:

  5.3. Changes to a confirmed booking (e.g., date changes, itinerary modifications) will be treated as a cancellation and rebooking and will be subject to the above cancellation fees, plus any administrative fees charged by the Company and our suppliers.

6. Modifications and Cancellations by Bizmorph
6.1. We reserve the right to modify itineraries, accommodations, or services due to unforeseen circumstances (e.g., weather, strikes, political instability, supplier issues) without prior notice. If such modifications are significant, we will inform you as soon as reasonably possible and offer you an alternative, a pro-rata refund for services not received, or (in the case of major changes) the option to cancel with a full refund.
6.2. If we cancel a booking due to low participation, force majeure, or any reason beyond our reasonable control, our liability is limited to a full refund of all monies paid to us for the canceled Services. We will not be liable for any additional costs incurred by you, such as visa fees, non-refundable flights, or other consequential losses.

7. Limitation of Liability and Disclaimer of Warranties
7.1. Bizmorph acts solely as an agent for various independent suppliers providing travel services (including airlines, hotels, transport operators, and tour guides). We are not the principal or direct provider of these services.
7.2. To the maximum extent permitted by law, Bizmorph disclaims all warranties, express or implied, regarding the Services, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
7.3. We are not liable for any injury, damage, loss, delay, accident, or irregularity that may occur due to the acts or omissions of any third-party supplier, or due to force majeure events, including but not limited to acts of God, war, terrorism, weather, or governmental actions.
7.4. Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Services, whether in contract, tort, or otherwise, is strictly limited to the total amount paid by you for the specific Service giving rise to the claim.

8. Indemnification
You agree to indemnify, defend, and hold harmless Bizmorph, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (i) your breach of these Terms; (ii) your violation of any law or the rights of any third party; or (iii) your use of our Services.

9. Intellectual Property Rights
All content on the Website, including text, graphics, logos, images, and software, is the property of Bizmorph or its content suppliers and is protected by Indian and international copyright laws. You may not reproduce, modify, distribute, display, or create derivative works from any content without our express prior written consent.

10. Governing Law and Dispute Resolution
10.1. This Agreement shall be governed by and construed in accordance with the laws of India.
10.2. Any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach thereof, shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved within 30 days, it shall be referred to and finally resolved by arbitration in [Your City, State] in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English by a single arbitrator appointed by mutual agreement. The decision of the arbitrator shall be final and binding.
